Article 7.06(3) - Repair of Inland AIS equipment installed on board that have a type approval in accordance with the test standard for Inland AIS, edition 1.0 or 1.01
According to article 7.06(3) of the Rhine Vessel Inspection Regulations (RVIR) [ES-TRIN], with effect from 1st December 2015, it will only be permitted to install Inland AIS equipment with a type approval based on edition 2.0 of the test standard for Inland AIS. The use of Inland AIS equipment installed before this date, type approval of which is based on edition 1.0 and 1.01, will on the other hand continue to be permitted.
a) Will an Inland AIS device which is type approved in accordance with the test standard for Inland AIS 1.01 or 1.0 and installed aboard a vessel be entitled to be repaired after 1st December 2015?
b) If an Inland AIS device installed aboard a vessel and which is type approved in accordance with the test standard for Inland AIS 1.01 or 1.0 is defective and temporarily requires to be replaced by another device, is this other Inland AIS device required to be type approved in accordance with the test standard for Inland AIS 1.01 or 1.0?

- On the whole, few items of equipment are defective or become so. Flexible measures for managing these scenarios therefore appear appropriate.
- Will an Inland AIS device which is type approved in accordance with the test standard for Inland AIS 1.01 or 1.0 and installed aboard a vessel be entitled to be repaired after 1st December 2015? This enables the boatmaster to continue to use the Inland AIS equipment with which he is familiar.
- If an Inland AIS device installed aboard a vessel and which is type approved in accordance with the test standard for Inland AIS 1.01 or 1.0 is defective, it can be temporarily replaced by another device, this other Inland AIS device being type approved in accordance with the test standard for Inland AIS 1.01 or 1.0. The notion of temporary is not defined and is left to the authorities’ discretion. They will be able to rely on the CCNR’s recommendation as to what to do in the event of a defective AIS device, the recommendation proposing a 48-hour period of tolerance.
- If on the other hand, a vessel is not equipped with an Inland AIS device and it needs to be equipped on a temporary basis because, unusually, this vessel is navigating the Rhine, then the Inland AIS equipment installed “temporarily” must be type approved in accordance with the test standard for Inland AIS 2.0. Indeed, in this scenario, we are not talking about replacement of existing equipment.
