ES-TRIN - Equipment/systems voluntarily installed onboard
General
In general provisions of ES-TRIN apply when the concerned equipment/system is voluntarily installed onboard. The installation of the equipment/system might result from the choice of the shipowner or may be required by local regulations. In the latter the equipment/system is mandatory, but not because it is required by ES-TRIN but for instance due to navigational authority regulations in the Member States.
The following examples could be given (for the vessel types where this provision is applicable):
- Article 6.06: Rudder-propeller, water-jet, cycloidal-propeller or bow-thruster systems are not mandatory in ES-TRIN. But if the vessel is equipped with such systems, the requirements of Article 6.06 apply, whereby also the exemption in Article 6.06(1) second paragraph should be taken into account (“such systems are not subject to this paragraph if they are not needed in order to achieve the manoeuvrability required by Chapter 5 or if they are only needed for the stopping test.”)
- Article 7.07: ES-TRIN includes requirements for radio telephony systems, but they only apply to vessels with wheelhouses designed for radar navigation by one person.
- Article 13.05: Permanently installed firefighting systems for protecting engine rooms are not mandatory in accordance with ES-TRIN, except for passenger vessels according to Article 19.12(9) (they might be mandatory in accordance with other regulations such as the ADN regulation). However, if such systems are voluntary installed on board, the requirements of Article 13.05 apply.
- Chapter 17: Liquefied gas installations for domestic purposes are not present on all vessels. However, if such installations are voluntary installed on board, the requirements of Chapter 17 apply.
This approach is also valid for special provisions applicable to certain vessel types (pleasure crafts, traditional vessels, floating equipment etc.). For the considered vessel type, this approach is then restricted to the applicable provisions in ES-TRIN.
Special case of pleasure craft
For pleasure craft, this approach is valid only for provisions listed in Chapter 26.
For example, Article 26.01(1)(h) refers to Article 13.04 which addresses the permanently installed firefighting systems for protecting accommodation spaces, wheelhouses and passenger rooms. It does not mean that such systems are mandatory for pleasure craft, but if they are voluntary installed on board, the requirements of Article 13.04 apply.
A contrario, Chapter 26 does not refer to Article 13.07 (ship’s boat). It means that the provisions of Article 13.07 do not apply to pleasure craft, even if a ship’s boat is voluntary installed on board. The same approach applies for navigational radar installation, because Article 7.06(1) is not mentioned in Chapter 26.
Police requirements
The compliance to ES-TRIN does not preclude the compliance to the police requirements which are applicable on the waterways where operates the craft. For example, the Rhine Police regulations (RPR) require a type-approved navigational radar installation in compliance with ES-TRIN, Article 7.06, notably if the vessel operates by night or in case of fog (“poor visibility”).
